1. General Provisions
MY3DLAB Ltd. (hereinafter referred to as “the Company”) provides services related to 3D modeling, 3D printing, and 3D scanning. By accessing or using this website, placing an order, purchasing any 3D models, or acquiring 3D-printed items, you acknowledge and accept these Terms of Use in full. If you do not agree with these terms, please do not use the website or any of the Company’s services.
2. Limitation of Liability
To the fullest extent permitted by applicable law, the Company, including its owners, employees, and partners, shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the use of its website, products, services, or deliverables. This includes, without limitation, loss of data, loss of revenue, loss of business, loss of profits, or damage to property.
Nothing in these Terms of Use shall limit or exclude liability for gross negligence, willful misconduct, or where such limitation is otherwise prohibited by law.
3. Quality Assurance and Warranty
The Company guarantees that all services and products provided will meet professional standards applicable to 3D modeling, 3D printing, and 3D scanning as outlined by MY3DLAB Ltd. If a product or service is found to be defective due to the Company’s fault (e.g., poor print quality not meeting agreed specifications or modeling errors not aligned with the client’s documented requirements), the Company will correct such issues at no additional charge to the client, excluding shipping costs and any incidental or consequential damages.
If the client does not provide specific requirements regarding print quality, modeling accuracy, or other technical aspects, the Company will rely on its professional expertise to recommend the best available solution. Upon client approval of such recommendations, the Company assumes no further responsibility for dissatisfaction with the final product.
All products and services are provided “as is,” without any warranties, express or implied, beyond the correction commitments stated above.
4. Third-Party Use
The Company is not responsible for any use, misuse, or modification of its deliverables by third parties. Once deliverables are transferred to the client, the client assumes full responsibility for any further use, modification, or distribution.
5. Exclusion of Liability for Legal Entities
The Company disclaims any liability for damages suffered by legal entities, businesses, or organizations resulting from the use of its website, products, or services, to the fullest extent permitted by law.
6. Client Responsibility
The client is solely responsible for ensuring that any products or services commissioned from MY3DLAB Ltd. comply with all applicable safety, regulatory, and legal requirements in the region or jurisdiction where they are used. The Company does not warrant compliance with any regional, national, or international regulations concerning 3D-printed objects, scanned models, or any other deliverables.
7. Order Cancellation
All orders placed through this website are considered final once confirmed. Cancellations may only be accepted at the sole discretion of the Company and must be requested in writing within 24 hours of order placement. If production or service work has already begun, cancellation may not be possible, or additional fees may apply to cover incurred costs.
The Company reserves the right to cancel any order at any time due to errors in pricing, product availability, or other unforeseen circumstances. In such cases, any payments made will be refunded in full.
8. Intellectual Property
All content on this website, including but not limited to text, graphics, logos, images, 3D models, and digital files, is the intellectual property of MY3DLAB Ltd. or its licensors and is protected by copyright and other applicable intellectual property laws.
For custom 3D modeling and design services, unless otherwise agreed in writing, MY3DLAB Ltd. retains ownership of the original design files and intellectual property rights. However, upon full payment, clients receive a broad, non-exclusive, royalty-free license to use, modify, and distribute the provided deliverables for any lawful purpose related to their personal or business needs.
If the client requires full ownership of the 3D models or exclusive rights, this can be arranged through a separate agreement upon request.
The Company is committed to fair and transparent use of intellectual property and welcomes open communication regarding client needs.
9. Dispute Resolution
In the event of any dispute, claim, or disagreement arising out of or relating to these Terms of Use, the services or products provided by the Company, or any other dealings between the client and MY3DLAB Ltd., both parties agree to attempt to resolve the matter through good faith negotiation.
If the dispute cannot be resolved through negotiation within thirty (30) days, the parties agree to submit the dispute to mediation before initiating any formal legal proceedings. Mediation shall take place in the jurisdiction where MY3DLAB Ltd. operates, and each party shall bear its own costs related to mediation.
If mediation does not result in resolution, either party may initiate legal proceedings, which shall be subject to the exclusive jurisdiction of the courts in the jurisdiction where MY3DLAB Ltd. is registered and operates.
Nothing in this section restricts either party from seeking immediate injunctive or equitable relief from a court of competent jurisdiction where such action is necessary to prevent irreparable harm.
10. Acceptance of Terms
By using this website, placing an order, purchasing any 3D models, or acquiring 3D-printed products or services from MY3DLAB Ltd., you expressly acknowledge and agree to be bound by these Terms of Use. Continued use of the Company’s website and services constitutes ongoing acceptance of these terms. You waive any right to dispute the enforceability of this agreement based on its form or method of acceptance.
11. Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of the jurisdiction in which MY3DLAB Ltd. operates. Any disputes shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.
