1. General Provisions and Regional Restrictions
MY3DLAB Ltd. (hereinafter referred to as “the Company”) provides services related to 3D scanning, reverse engineering, 3D modeling, and additive manufacturing (including FDM, SLA, SLS, and MJF). By accessing or using this website, placing an order, purchasing any digital 3D models, or acquiring physical 3D-printed items, you acknowledge and accept these Terms and Conditions in full. If you do not agree with these terms, please do not use the website or any of the Company’s services.
Regional Restriction: The Company does not provide services, sell products, or solicit business to residents of the Province of Quebec. Any inquiries or orders placed from, or requesting delivery to, the Province of Quebec will be declined and cancelled.
2. Limitation of Liability and End-Use Application
To the fullest extent permitted by applicable law, the Company, including its owner, employees, and partners, shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profit, loss of reputation or goodwill, loss of confidential or other information, loss of data, loss of revenue, equipment downtime, damage to property, or liability for any third-party claims against the user, arising out of or related to the use of its website, products, services, or deliverables. These exclusions and limitations of liability apply to all causes of action, whether in contract, tort (including negligence), strict liability, breach of statutory duty, or otherwise. Given the nature of custom fabrication and reverse engineering, all deliverables intended for functional, mechanical, automotive, marine, or industrial applications are provided for experimental, prototyping, or custom-repair purposes. The Company assumes no liability for parts failing under operational loads. Nothing in these Terms shall limit or exclude liability for gross negligence, willful misconduct, or where such limitation is otherwise prohibited by law.
3. Quality Assurance and Warranty
The Company guarantees that all services and products provided will meet professional standards applicable to 3D scanning and additive manufacturing based on the specifications agreed upon. Upon receipt of the deliverables, the client has fourteen (14) days to inspect the product. If a product or service is found to be defective due to the Company’s fault (e.g., poor print quality not meeting agreed specifications, or severe modeling errors not aligned with the provided physical part), the Company will correct such issues at no additional charge to the client, excluding shipping costs. If the client does not provide specific requirements regarding print tolerances, material strength, or modeling accuracy, the Company will rely on its professional expertise to recommend the best available solution. All products and services are provided “as is,” without any warranties, express or implied, beyond the correction commitments stated above.
4. Indemnification
You agree to defend, indemnify, and hold harmless MY3DLAB Ltd., its agents, assigns, employees, contractors, and service providers and their respective successors and assigns, from and against any and all claims, demands, actions, proceedings, liabilities, judgements, penalties whether civil or criminal, taxes, and all costs, liabilities and expenses (including, without limitation, reasonable legal fees) arising out of or relating to your use of the service or that may be incurred by MY3DLAB Ltd. arising out of, or relating to your use of the MY3DLAB Ltd. service, your violation of these terms, the misuse or illegal use of the service, applicable law or rights of any third parties, your failure to comply with applicable laws and regulations, or your negligence or willful misconduct.
5. Client Responsibility and Intellectual Property Rights of Source Objects
The client is solely responsible for ensuring that any products or services commissioned from MY3DLAB Ltd. comply with all applicable safety, regulatory, and legal requirements in the region or jurisdiction where they are used. Important: When submitting physical parts for 3D scanning or reverse engineering, the client warrants and represents that they have the legal right, ownership, or proper authorization to duplicate, reverse-engineer, and reproduce the item. The Company assumes no responsibility for intellectual property or patent infringement arising from the reproduction of objects supplied by the client.
6. Order Cancellation
All orders placed are considered final once confirmed. Cancellations may only be accepted at the sole discretion of the Company. If production (3D printing) or engineering work (scanning/CAD modeling) has already commenced, cancellation is not possible, and the client remains responsible for the costs incurred up to that point. The Company reserves the right to cancel any order at any time due to unfeasible geometry, material unavailability, or other unforeseen circumstances. In such cases, any advanced payments made will be refunded.
7. Intellectual Property of Deliverables
All general content on this website (text, graphics, logos, images) is the intellectual property of MY3DLAB Ltd. For 3D scanning, reverse engineering, and modeling services, unless otherwise agreed in writing, MY3DLAB Ltd. retains ownership of the raw data, working files, and underlying intellectual property rights. However, upon full payment, the client receives a non-exclusive, royalty-free, revocable, non-transferable, and non-sublicensable license to use, modify, and distribute the final provided deliverables (.STL, .STEP, .OBJ files, or physical prints) for any lawful purpose related to their personal or business needs. If the client requires full, exclusive ownership of the digital design files (e.g., for proprietary inventions), this must be arranged through a separate written agreement prior to the start of the project.
8. Dispute Resolution
In the event of any dispute, claim, or disagreement arising out of or relating to these Terms, the services provided by the Company, or any other dealings between the client and MY3DLAB Ltd., both parties agree to first attempt to resolve the matter through good faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, the parties agree to submit the dispute to mediation in Calgary, Alberta, before initiating any formal legal proceedings. Each party shall bear its own costs related to mediation.
9. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Calgary, Alberta.

12. Force Majeure
MY3DLAB Ltd. shall not be held liable or responsible for any failure or delay in fulfilling its obligations under these Terms when and to the extent such failure or delay is caused by or results from events beyond the Company’s reasonable control. Any attempt to alter or amend these terms shall be null and void, unless explicitly agreed to in a written document signed by an authorized representative of both parties.
